When You Book with us directly or through any of our affiliate of third party then it means your direct acceptance of the “Terms of Use” and your agreement to be legally bound by the same.

Here Uttarakhandtriptrek, UTT refers to us i.e Uttarakhandtriptrek pvt ltd.

1. PRIVACY POLICY

2 . TRIP CANCELLATION BY UTTARAKHANDTRIPTREK LTD.

UTT reserves the right to cancel a departure and will advise you of such cancellation no later than 20 days before the tour departure date. If due to ‘Force Majeure’ or government travel advice, UTT reserves the right to cancel departure, including a guaranteed one, at any time. With any form of cancellation, UTT will offer you alternative arrangements, and if the price of your alternative booking is of lower value than the original booking UTT will refund the difference to you. If you do not accept alternative arrangements UTT will refund all payments you have made to UTT, (in case of ‘Force Majeure’ or government travel advice, refunds will be less any unrecoverable costs). UTT will not be liable for any additional cost incurred by you for any damages or claims in connection with these cancellations.

3.  CHANGE IN ITINERARY

You acknowledge that travelling with UTT requires a degree of flexibility, good humour and an understanding that the itinerary accommodation, and / or modes of transport may change, even after a tour’s commencement, without prior notice due to local circumstances. Changes may occur because of ‘Force Majeure’, poor road conditions, weather, and the availability of tickets, vehicle breakdowns, changes in transport schedules, accidents or other circumstances beyond UTT’s control or which simply cannot be foreseen. UTT does not accept any responsibility for loss of enjoyment, delays or compensation resulting from circumstances beyond UTT’s control. You acknowledge that group sizes may also vary during the duration of the tour.
The information about trips given in any brochures, trip notes and pre departure information are subject to change. It is your responsibility to review up – to – date trip notes and pre departure information. These can be obtained from UTT or UTT’s website. The information and conditions in the trip notes and pre departure information are deemed to be part of the contract. Where changes to your trip occur after you have received your final documentation we will, where practical, advise you or your agent of such changes.

4.  PHYSICAL FITNESS

UTT will supply an exercise schedule, links (which is supplied on conformation by UTT). The supplied exercise schedule should be followed prior to commencing any trip (see trip grading). If you suffer from severe muscular, chest, heart, asthmatic, or bronchial disorders, or have high blood pressure you are advised against coming on UTT trekking trips that go to altitude.
All travellers over the age of sixty will be required to obtain a medical certificate of fitness. If you fail your medical, a full refund of deposit paid will be made, providing the medical as requested by UTT is returned within two weeks of booking.

Please note: Discovery of any undisclosed medical conditions will result in you being asked to leave the trip and will invalidate most insurance policies.
UTT reserves the right to cancel your participation in a trip at any time after trip commencement with no right of refund if your lack of fitness (for the grading of the booked trip), medical condition and/or disability could reasonably affect the trip or your safety and/or the enjoyment of other trip members.

5.  TRAVEL INSURANCE

Personal travel insurance is not included in the tour/trip price. While every effort is made to ensure the safety for all, it is advisable that you obtain personal travel insurance that is adequate to cover you for any event. Your travel insurance must cover accidents, injury, illness and death medical expenses, including any related to pre-existing medical conditions, emergency repatriation (including helicopter rescue and air ambulance where applicable) and personal liability. UTT also recommends your travel Insurance covers cancellation, curtailment and loss of luggage and personal effects. You must carry proof of insurance and produce it if reasonably requested by UTT employees or suppliers.

6.  RISKS ASSOCIATED

While every effort will be made to ensure your safety and follow UTT itineraries, in the event of political problems or natural difficulties which are beyond UTT control and prevent our travelling to a particular area, UTT reserves the right to substitute an alternative activity for that section of the trip. The cost of any such changes or delays shall not be the responsibility of agents or UTT. By accepting UTT terms and conditions you acknowledge your decision to travel on a UTT trip is made after you have considered all relevant travel information supplied by UTT and travel advice provided at any time by government bodies and associated agencies.

If you suffer injury or illness, UTT can at any cost, arrange medical treatment and emergency evacuation service, as they deem essential for your safety. In entering into this agreement you are not relying on any oral, written or visual representatives or statements by UTT or its staff or any other inducement or coercion to go on the adventure trip, but entirely of your own free will.

You also confirm that you accept liability for loss, injury, death, or damage, however caused which you may directly or indirectly suffer in connection with your trip within the extent permitted by law. You also accept the physical exertion and that the weather extremes are subject to sudden unexpected change, remoteness from normal medical services and evacuation and its difficulties if you are disabled.

7 .  GOVERNING LAW

This contract and all provision of the services and matters arising from it are governed by and in accordance with Indian Law and any dispute arising with be subject to the juridication of Uttarakhand Courts.

8.  TRADEMARK INFORMATION

Uttarakhandtriptrek.com, Uttarakhandtriptrek logo, and other company logos and product and service names are trademarks of Uttarakhandtriptrek Pvt Ltd. Without company’s prior permission, you agree not to display or use them in any manner.

9.  COPYRIGHTS AND COPYRIGHT AGENTS

Company respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide company the following information at info@uttarakhandtriptrek.com (a) An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest; (b) A description of the copyrighted work or other intellectual property that you claim has been infringed; (c) A description of where the material that you claim is infringing is located on the site; (d) Your address, telephone number, and email address; (e) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; Company’s Agent for Notice of claims of copyright or other intellectual property infringement can be reached as follows info@uttarakhandtriptrek.com Company does not claim ownership of the images, pictures or photos on Uttarakhandtriptrek Application. The images are our own property and sometimes user contributed. Company is not liable for any damages, claims that may arise out of any copyright violation that happens because of user contributed images.
